Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.<br><br>These booking conditions only apply to the trip arrangements which you book with us in the Kyrgyz Republic and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references in these booking conditions to \u201ctrip\u201d, \u201cbooking\u201d, \u201ccontract\u201d or \u201carrangements\u201d mean such trip arrangements unless otherwise stated. References to \u201cdeparture\u201d mean the start date of these arrangements.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-3259dfe6\"><h1 class=\"uagb-heading-text\"><strong>Booking your trip and payment details<\/strong><\/h1><\/div>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-589e2a6a\"><h2 class=\"uagb-heading-text\"><strong>1. Booking procedure<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">To make a booking please follow the procedure shown on our website. The relevant application form needs to be completed by each person travelling. Where you are under 18 at the time of booking, the application form also needs to be signed by your parent or guardian or initialled online during the booking process. The completed booking form must then be sent to us together with the payments referred to in paragraph 2 below.<br><br>Where we have already confirmed the availability of your chosen arrangements and you book within any applicable time limit for doing so, your booking will be treated as firm and a contract between us will come into existence as soon as we receive your completed application form and your deposit. We will then send you a receipt for all payments made and our invoice. Where we have not confirmed availability, your booking will be treated as firm and a contract between us will come into existence when we dispatch our invoice to you. Where you book through our website without prior confirmation of availability, any electronic acknowledgement of your booking is not a confirmation of it. Please check your invoice carefully as soon as you receive it. Contact us immediately if any information which appears on the invoice or any other document appears to be incorrect or incomplete.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-071f12f7\"><h2 class=\"uagb-heading-text\"><strong><strong>2. Deposit<\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A minimum non-refundable deposit<\/strong> of \u20ac400 per person must accompany the booking. Please note that a higher deposit may be required for some selected trips. We also offer and encourage an instalment plan with 50% of the trip payment made by a minimum of 3 months prior to departure. In any case the full balance must be received by us by four weeks prior to trip start date. Bookings made within four weeks require immediate full payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, for any reason, the balance (including any surcharge where applicable) is not received by the due date, we reserve the right to treat the booking as cancelled by you. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in paragraph 7 depending on the date we reasonably treat your booking as cancelled. All bank charges, transaction fees, and currency conversion costs are the responsibility of the Client.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-1452b252\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>3. The price<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The price quoted for any trip covers the cost of the planning, the organisation and carrying out of the trip, including group equipment, supplies, accommodation, administration and staff, except for the following, for which the you must be responsible: travel insurance, cost of travel to and from the start \/ return point of your trip including your international flights, cost of passport and visas, personal equipment and personal expenses, vaccination fees while on the trip and any other expenses specifically excluded on the trip description and\/or invoice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We reserve the right to make changes to and correct errors in quoted prices at any time before your trip is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The price of the tour is determined based on the number of participants<\/strong> and is clearly indicated on our website at the time of booking. As group size directly affects operational costs, the final price of the tour may be subject to adjustment if the number of confirmed participants changes. Accordingly, a price increase or decrease (as applicable) may be applied in line with the pricing structure published on our website. Any such adjustment will only be made where the actual number of participants differs from the initially expected group size on which the provisional price was based. Where the number of participants decreases, resulting in higher per-person costs, the Company reserves the right to apply a surcharge in accordance with the relevant price tier. Where the number of participants increases, resulting in lower per-person costs, the Client will be entitled to a corresponding reduction in the tour price. The applicable price adjustment will be communicated to the Client once the final group size is confirmed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By making a booking, you acknowledge and accept that the tour price is variable and dependent on group size, the final price may increase or decrease accordingly, such adjustments are not considered changes to the contract but are part of the agreed pricing structure. No price adjustments will be made after the tour has commenced.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-76aa9bb2\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>4. Travel insurance<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">It is essential that you have adequate and appropriate cover for your trip including any adventurous activities such as trekking at altitude. You are solely responsible for arranging and purchasing your own travel insurance. It is important to have adequate insurance which will cover cancellation costs from the date of booking as well as medical expenses (including evacuation and repatriation). Please read your policy details carefully and take them with you on your trip. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-4f778fac\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>5. Health<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Except as disclosed in your medical questionnaire, you are taken to confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the trip, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the trip, taking into account its challenges and purposes. If you are unable to give this confirmation for any reason or have any medical condition or disability which may affect your trip, you must contact us before you submit your application form so that we can assist you in considering the suitability of the trip for you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If any information given in the application form or medical questionnaire is shown to be materially incorrect or incomplete, we reserve the right to cancel your booking or terminate your participation in the trip, depending on when we become aware of the true position. In this situation, any applicable cancellation charges will apply in accordance with our Cancellation &amp; Refund Policy, and no refund may be issued where cancellation occurs within non-refundable periods. The Company shall not be responsible for any costs or expenses incurred by the Client as a result of such cancellation or termination.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8c85f817\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>6. Special requests.<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Please advise us of any special requests prior to making your booking. Where possible, we will endeavour to meet or arrange for our suppliers to meet any such request. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your own protection, you should obtain confirmation in writing that a special request will be complied (where it is possible to give this) where it is important to you.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-3b91e45b\"><h1 class=\"uagb-heading-text\"><strong>Cancellations and changes<\/strong><\/h1><\/div>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-c2f27d04\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>7. Cancellation of bookings<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Cancellation of bookings must be notified to us by letter or email by the party leader as soon as possible. Your notice of cancellation will only be effective when it is received in writing by us. Except as set out in paragraph 8 below, the following cancellation charges will be payable.<\/p>\n\n\n\n<figure class=\"is-style-regular wp-block-table\"><table class=\"has-border-color has-ast-global-color-4-border-color has-fixed-layout\" style=\"border-width:2px\"><thead><tr><th class=\"has-text-align-left\" data-align=\"left\">Period before trip start date, within which written notification of cancellation is received by us<\/th><th class=\"has-text-align-left\" data-align=\"left\">Cancellation charge per person cancelling (% of total cost)<\/th><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\">6 weeks (42 days) or more<\/td><td class=\"has-text-align-left\" data-align=\"left\">Non-refundable deposit of 30%<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\">Less than 6 weeks (41 days) \u2013 4 weeks<\/td><td class=\"has-text-align-left\" data-align=\"left\">50%<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\">Less than 4 weeks (27 days) to 2 weeks<\/td><td class=\"has-text-align-left\" data-align=\"left\">75%<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\">Less than 2 weeks (13 days) to date of trip start date<\/td><td class=\"has-text-align-left\" data-align=\"left\">100%<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-b59fda4b\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>8. Cancellation Charge<\/strong><\/strong><\/strong>s<\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">If you cancel your booking, cancellation charges will apply based on the timing of your cancellation and the costs already incurred by the Company in relation to your booking. These charges reflect the administrative, operational, and supplier costs that are reasonably incurred at the time of cancellation and may increase closer to the departure date. We always aim to apply cancellation charges fairly and in proportion to the actual costs incurred in preparing your trip. Depending on the reason for cancellation, you may be able to recover some or all of these costs under your travel insurance policy. Any such claims must be made directly with your insurance provider.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-e6edd35f\"><h2 class=\"uagb-heading-text\"><strong>9. Transfer of Your Booking to Another Person<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">You may transfer your place to someone else (introduced by you) if you are prevented from travelling, providing we are notified not less than 2 weeks before departure and subject to practicality of changing certain bookings made in your name. All costs and charges incurred by us and\/or incurred or imposed by any of our suppliers as a result must be paid before the transfer can be effected. Any overdue balance payment must also be received.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-3cf2cd14\"><h2 class=\"uagb-heading-text\"><strong>10. Changes<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Changes to your confirmed trip <\/strong>can be considered depending on practicalities and availabilities, but there might be a cost associated with these changes. We do not charge an amendment fee for doing so and will only pass on any extra costs involved in providing additional or alternative services which are incurred or imposed by any of our suppliers. A change of holiday dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply. Changes may result in the recalculation of the holiday price where, for example, the basis on which the price of the original holiday was calculated has changed.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8896417c\"><h2 class=\"uagb-heading-text\"><strong>11. The itinerary<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The<\/strong> <strong>itinerary<\/strong> <strong>is a guide<\/strong> to which we will attempt to adhere, but it may be necessary to alter this at short notice as a result of circumstances or events outside our control such as adverse weather or road conditions or any of those amounting to force majeure (see paragraph 13), or due to the operating conditions imposed by owners and operators of accommodation, facilities and transport. Your itinerary will, however, be the same in content as far as is reasonably possible, unless circumstances beyond our control make this impossible. Should weather conditions involve you in extra costs such as accommodation, transportation and meals, these will be borne by mutual agreement between us.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-cc3d2565\"><h2 class=\"uagb-heading-text\"><strong>12. Changes and cancellation by us.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">As referred to above, we may have to make changes to and correct errors in advertised and confirmed details and also cancel confirmed bookings which we must reserve the right to do. Please note, our trips may require a minimum number of participants to enable us to operate them. If the minimum number of bookings required for a particular trip has not been received, we are entitled to cancel it. We will notify you of cancellation for this reason no less than 28 days prior to departure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most changes are minor. Occasionally, we have to make a \u201csignificant change\u201d. A significant change is a change made before departure which we can reasonably be expected to have a major effect on your trip. If we have to make a significant change or cancel, we will tell you as soon as possible. If there is time to do so before departure, we will offer you the choice of the following options:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\">(for significant changes) accepting the changed arrangements; or<\/li>\n\n\n\n<li class=\"\">purchasing an alternative trip from us, of a similar standard to that originally booked if available. We will offer you at least one alternative trip of equivalent or higher standard for which you will not be asked to pay any more than the price of the original trip. If this trip is in fact cheaper than the original one, we will refund the price difference. If you do not wish to accept the trip we specifically offer you, you may choose any of our other then available trips but you must pay the applicable price of any such trip. This will mean you paying more if it is more expensive or receiving a refund if it is cheaper;<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Please note, the above options are not available where any change made is a minor one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we have to make a significant change or cancel we will, where appropriate, pay you the reasonable compensation depending on the circumstances and when the significant change or cancellation is notified to you subject to the following exceptions. Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\">we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control such as force majeure, the consequences of which we could not have avoided even with all due care; or<\/li>\n\n\n\n<li class=\"\">where applicable, we have to cancel because the minimum number of bookings necessary for us to operate your trip has not been reached (see above).<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">No compensation will be payable and the above options will not be available if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel (such as paying on time) or where a change is a minor one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Very rarely, we may be forced by \u201cforce majeure\u201d (see paragraph 13) to change or terminate your trip after departure but before the scheduled end of your time away. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our suppliers), pay you any compensation or meet any costs or expenses you incur as a result.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-43f13a32\"><h2 class=\"uagb-heading-text\"><strong>13. \u201cForce majeure\u201d<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">In these booking conditions, \u201cforce majeure\u201d means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, significant risks to human health such as the outbreak of serious disease at the travel destination, adverse or unpredictable weather conditions, including sudden weather changes, high altitude conditions and altitude sickness, landslides, rockfalls, and other natural hazards, remoteness from infrastructure and limited access to services, delays or limitations in the provision of emergency or medical assistance and all similar events outside our control. Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of \u201cforce majeure\u201d.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-7dc66ddd\"><h1 class=\"uagb-heading-text\"><strong>14. Our Liability to you<\/strong><\/h1><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">We promise to make sure that the trip arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these booking conditions, we will accept responsibility if, for example, you suffer death or personal injury or your contracted trip arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted trip arrangements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We will not be responsible for any injury, illness, death, loss (including loss of possessions and loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">your act(s) and\/or omission(s); or<\/li>\n\n\n\n<li class=\"\">the act(s) and\/or omission(s) of a third party not connected with the provision of your trip and which were unforeseeable or unavoidable; or<\/li>\n\n\n\n<li class=\"\">\u2018force majeure\u2019 as defined in paragraph 13 above<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services which any supplier agrees to provide or arrange for you where we have not agreed to provide or arrange these services as part of our contract. Such additional services will include any activities which do not form part of your contracted trip arrangements which a supplier agrees to provide or arrange for you while you are away.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The services provided by the Company shall be assessed in accordance with the terms of this Agreement and the laws and regulations of the Kyrgyz Republic. Any claim or complaint will be evaluated based on whether the services were delivered in compliance with the applicable laws, standards, and practices in force in the Kyrgyz Republic at the time the services were provided.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the services in question complied with local laws and regulations, they shall be considered as properly provided, even if they do not meet the standards or regulations of any other country. An exception may apply in cases where a significant safety deficiency is identified which would reasonably have led a participant to refuse participation in the tour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where any claim or part of a claim arises from or is connected with transport services provided by third-party providers (including, but not limited to, road transport or rail services within the Kyrgyz Republic), the Company\u2019s liability shall be limited to the maximum extent permitted under the applicable laws of the Kyrgyz Republic and the terms and conditions of the respective transport provider<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maximum compensation payable by the Company shall not exceed the amount which the relevant transport provider would be required to pay under applicable law or their own terms. Where a transport provider would not be obliged to make any payment in respect of a claim, the Company shall likewise not be obliged to make any payment for that claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of any payment by the Company, we reserve the right to deduct any amounts already received or receivable by the Client from the transport provider in connection with the same claim. Copies of the relevant transport providers\u2019 terms and conditions are available upon request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Company shall not be liable for:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\">Any loss, damage, or expense which, based on the information provided by the Client prior to booking, could not reasonably have been foreseen at the time the contract was concluded;<\/li>\n\n\n\n<li class=\"\">Any loss, damage, or expense which does not arise from a breach of contract or fault on the part of the Company, its employees, or its suppliers (where the Company is legally responsible for them);<\/li>\n\n\n\n<li class=\"\">Any indirect or consequential losses, including but not limited to loss of profit, loss of business, or loss of income (including for self-employed persons).<\/li>\n<\/ol>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-d4e67507\"><h2 class=\"uagb-heading-text\"><strong>15. Third-Party Services.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">In the course of delivering our tours, the Company works with a range of local partners and service providers, which may include drivers and transport providers; guesthouses and accommodation providers; local hosts and homestay families and other independent suppliers. These services are provided by third parties who operate in accordance with their own standards and local practices.<br><br>While the Company carefully selects its partners, we do not have direct control over their day-to-day operations. Accordingly, the Company shall not be liable for the acts, omissions, or negligence of such third-party providers, except where required by applicable law. However, we will use reasonable efforts to assist in resolving any issues that may arise during the provision of such services.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8db56480\"><h2 class=\"uagb-heading-text\"><strong>16. Transport &amp; Infrastructure.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Travel within the Kyrgyz Republic may involve conditions that differ significantly from those in more developed destinations. By booking a tour, you acknowledge and accept that road conditions may be uneven, unpaved, or challenging; travel times may vary significantly due to weather, terrain, or other local factors; infrastructure, particularly in rural or remote areas, may be basic or limited. You understand that such conditions are an inherent part of travel in the Kyrgyz Republic and form part of the overall experience. The Company shall not be liable for any delays, inconvenience, or discomfort arising from these conditions, except where such liability cannot be excluded under applicable law.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-29b98b47\"><h2 class=\"uagb-heading-text\"><strong>17. Activities &amp; Interaction with Animals.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Certain activities offered as part of our tours \u2014 including, but not limited to, hiking, horse riding, swimming, and other outdoor experiences \u2014 involve inherent risks. By participating in such activities, you acknowledge and accept that animals, including horses and other livestock, can be unpredictable; terrain and natural environments may be uneven, remote, or physically challenging; safety standards and conditions may differ from those in your home country. Participation in any such activities is entirely voluntary and undertaken at your own risk. The Company shall not be liable for any injury, loss, or damage arising from participation in these activities, except where such liability cannot be excluded under applicable law.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-4f540dc0\"><h2 class=\"uagb-heading-text\"><strong>18. Accommodation &amp; Local Conditions.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Accommodation provided during the tour may vary in standard, particularly in rural or remote areas. You acknowledge and accept that certain types of accommodation, including guesthouses, homestays, or traditional yurts, may involve basic or shared sanitary facilities; limited or intermittent heating, electricity, or hot water; traditional living conditions reflecting local culture and lifestyle. Such conditions are an integral part of the travel experience in the Kyrgyz Republic. By booking a tour, you agree to accept these variations in comfort and infrastructure as part of the overall experience. The Company shall not be liable for any discomfort or inconvenience arising from such conditions, provided that the services have been delivered in accordance with local standards.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-a758e638\"><h2 class=\"uagb-heading-text\"><strong>19. Personal Belongings.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">You are solely responsible for the safety and security of your personal belongings at all times during the trip. The Company shall not be liable for any loss, theft, or damage to personal property, including money, documents, or valuables, except where such liability cannot be excluded under applicable law. We strongly recommend that you take appropriate precautions and obtain travel insurance to cover personal belongings.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-2475fc8b\"><h1 class=\"uagb-heading-text\"><strong>Delays, behaviour, damage and complaints<\/strong><\/h1><\/div>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-91122263\"><h2 class=\"uagb-heading-text\"><strong>20. Delay.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">We regret we are not in a position to offer you any assistance in the event of delay at your outward or homeward point of departure. However, we have no liability to make any such payments to you and you must pursue the airline or other transport operator concerned for any payment which may be due. Please remember that it is your responsibility to ensure you arrive at the departure location for your chosen tour, all costs associated with this are therefore your sole responsibility. This is even the case where we assist you in making any necessary additional arrangements where, for example, your flights were delayed and you missed your pre-booked transfer with us.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-f7fc9643\"><h2 class=\"uagb-heading-text\"><strong>21. Conditions of suppliers<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Suppliers, including transport operators, provide their services in accordance with their own terms and conditions. These terms may limit or exclude their liability to you in the event of death, personal injury, delay or loss \/ damage of personal possessions.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8c871519\"><h2 class=\"uagb-heading-text\"><strong>22. Decisions of Deep Roots &amp; Bishkek Walks, behaviour and damage.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">While the trip is in progress, all decisions are made by representatives of Deep Roots &amp; Bishkek Walks, including but not limited to employees of the Company &#8211; guides and team leaders, partners, assistants, or other authorized individuals involved in the organization and delivery of the tour. You agree to follow all reasonable instructions given by guides and staff, behave in a responsible and respectful manner, respect local laws, customs, traditions, and cultural norms, act in a way that does not negatively affect the experience of other participants<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any member of the Company\u2019s team or authorized representatives may withdraw you from the trip at any time if, in their reasonable opinion, your continued participation:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\">disrupts or is likely to disrupt the good order or discipline of the group<\/li>\n\n\n\n<li class=\"\">poses a risk to the safety or wellbeing of yourself or others<\/li>\n\n\n\n<li class=\"\">negatively affects the experience of other participants<\/li>\n\n\n\n<li class=\"\">interferes with the successful operation of the tour<\/li>\n\n\n\n<li class=\"\">involves a breach of any applicable laws or regulations<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases no refund will be provided and the Company shall not be liable for any resulting costs or expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you behave in such a way as to cause or be likely to cause danger, upset or distress to our staff or to any third party or damage to property, we are entitled, without prior notice, to terminate your trip.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We are entitled to withdraw you from a trip in the above circumstances where the information provided on your application form or medical questionnaire proves to be materially inaccurate or incomplete. Where you are withdrawn, you will be required to leave the trip immediately and we will have no further responsibility towards you. No refunds will be made and we will not pay any expenses or costs incurred as a result of the withdrawal. You will in addition have to indemnify us against any loss or expense that may be incurred as a result of your actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made direct to the accommodation owner or manager or other supplier or to us as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other party\u2019s full legal costs) as a result of your actions. You should ensure you have appropriate travel insurance to protect you if this situation arises.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-a076438e\"><h2 class=\"uagb-heading-text\"><strong>23. Passport and visa requirements.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Most foreign nationals, including citizens of Europe, the United Kingdom, the United States, Canada, Australia, and many other countries, are eligible for visa-free entry to the Kyrgyz Republic for tourism purposes for a period of up to 60 days, subject to applicable immigration rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, visa and entry requirements may vary depending on your nationality and may change at any time. It is your responsibility to ensure that you meet all current entry requirements well in advance of your departure. You must ensure that your passport is valid for the entire duration of your stay, you comply with all entry, exit, and transit requirements applicable to your nationality, you have checked the latest requirements with the relevant official authorities if your situation is not covered by visa-free entry rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you hold multiple citizenships or are travelling on a passport different from your country of residence, you are responsible for verifying the applicable entry requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must ensure you are in possession of all necessary travel and health documents before departure. All costs incurred in obtaining such documentation must be paid by you. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-152d1419\"><h2 class=\"uagb-heading-text\"><strong>24. Health requirements.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for ensuring that you are medically and physically fit to participate in the trip booked with us. Some of our tours may involve walking, travel at altitude, and exposure to remote environments where medical facilities may be limited. It is your responsibility to consider whether the trip is suitable for you, taking into account your personal health condition, fitness level, and any pre-existing medical issues. You must inform us prior to departure of any relevant medical conditions, allergies, dietary requirements, or other health-related circumstances that may affect your ability to safely participate in the trip.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We strongly recommend that you seek medical advice from a qualified healthcare professional before travelling, particularly if you are unsure whether your participation in the trip is appropriate. The Company reserves the right to refuse participation or remove a Client from a trip if, in our reasonable opinion, their health condition may pose a risk to themselves or to other participants, or may prevent the safe or effective operation of the trip. The Company shall not be liable for any illness, injury, or health-related issues arising during the trip, except where such liability cannot be excluded under applicable law.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-373e6314\"><h2 class=\"uagb-heading-text\"><strong>25. Complaints.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">In the unlikely event that you have any reason to complain or experience any issues during your trip, you must inform your tour guide, trip leader, or any authorised representative of the Company as soon as possible so that the issue can be addressed promptly on the spot. Where possible, any verbal complaint should be confirmed in writing and provided to your guide or Company representative during the trip. If the issue cannot be resolved immediately to your satisfaction, you must contact the Company using the contact details provided to you before or during your trip, providing full details of the issue and, where possible, a contact number. Most issues can be resolved quickly and locally if raised in a timely manner. Until we know about a complaint or problem, we cannot begin to resolve it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you remain dissatisfied after the end of your trip, you must submit a written complaint to us within 14 days of the completion of your trip, including your booking reference and full details of the complaint. For complaints or claims that do not involve death, personal injury, or illness, the Company may not accept liability if you fail to follow the procedure set out in this clause. In the unlikely event that a dispute cannot be resolved amicably, the matter may be referred to the competent courts of the Kyrgyz Republic, in accordance with applicable local law.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-950030ae\"><h1 class=\"uagb-heading-text\"><strong>Contract law and financial security<\/strong><\/h1><\/div>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-b648d2da\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong>26. Your contract:<\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms &amp; Conditions and any agreement between the Client and the Company shall be governed by and construed in accordance with the laws of the Kyrgyz Republic. Both the Client and the Company agree that any dispute, claim, or matter arising out of or in connection with the booking, the tour, or these Terms shall be subject to the exclusive jurisdiction of the courts of the Kyrgyz Republic. By making a booking, you expressly agree to submit to the jurisdiction of the courts of the Kyrgyz Republic and waive any right to bring proceedings in any other jurisdiction, except where such waiver is not permitted under applicable law.
